THIS TICKET IS A REVOCABLE LICENSE. USER ACCEPTS RISK OF INJURY.
- Acceptance of Terms. By entering the United States Olympic and Paralympic Museum (“Museum”), the ticket purchaser/holder (“Holder”) certifies that Holder has reviewed and accepts these terms, for Holder and, as a parent or legal guardian, on behalf of any accompanying minor. Holder represents that Holder is legally competent to enter this Agreement and, as to any accompanying minor, that Holder is that minor’s parent or legal guardian and is authorized to release and waive the minor’s prospective claims, including negligence claims, on the minor’s behalf. If Holder does not agree, Holder should return the ticket immediately, before entering, for a refund.
- Ticket; Limited License. This ticket is a limited license for access to the Museum, revocable at any time, with or without cause, in the Museum’s discretion. It is valid only for the date on its face and only for use by Holder. It is non-transferable and may not be resold or used for any promotional purpose (including contests, sweepstakes, or giveaways) without the Museum’s prior written permission.
- Assumption of Risk. HOLDER, ON BEHALF OF HOLDER AND ANY ACCOMPANYING MINOR, VOLUNTARILY ASSUMES ALL RISK OF INJURY, HARM, OR INCIDENT ARISING FROM USE OF THIS TICKET, INCLUDING (A) ALL RISK OF EXPOSURE TO OR CONTRACTION OF INFECTIOUS DISEASE OR ILLNESS, (B) ALL OTHER RISK OF PERSONAL INJURY, AND (C) ALL RISK OF LOST, STOLEN, OR DAMAGED PROPERTY.
- Release of Liability. HOLDER RELEASES THE MUSEUM FROM ANY CLAIMS AND LIABILITIES ARISING FROM USE OF THIS TICKET. This release applies to the Museum’s ordinary negligence to the fullest extent permitted by law. It does not release, or limit the Museum’s liability for, willful and wanton, reckless, or grossly negligent conduct, and does not waive any right that cannot be waived under applicable law.
- Photography & Likeness. Visitors may be filmed or photographed. By using this ticket, Holder irrevocably grants the Museum and those it authorizes permission to use the image, likeness, name, voice, and comments of Holder and any accompanying minor for the Museum’s advertising, marketing, promotional, educational, editorial, and archival purposes, in any media now known or later developed, without compensation, notice, or approval. Holder may take photographs and video for personal use only; they may not be used for broadcast, publication, or any commercial purpose without the Museum’s prior written permission.
- Conduct, Security & Prohibited Items. No outside food or beverage, including chewing gum, is allowed. All persons and bags are subject to search and security checks. No dangerous objects—including guns, knives, weapons, fireworks, sparklers, flammable or aerosol substances, lighters, or matches—are permitted, and no open flames of any kind are permitted on Museum property. The following are not permitted without the Museum’s prior written approval: confetti, glitter, table sprinkles, balloons and similar items; and special-effects equipment, including smoke, haze, or fog machines, laser displays, aerosol sprays and pyrotechnics. The Museum is a non-smoking, tobacco-free facility.
- Damage; Indemnification. Holder is responsible for any damage Holder or any accompanying minor cause to the Museum or its property, and will pay the Museum on demand sufficient funds to restore it to original condition, together with all collection costs, including reasonable attorneys’ fees. Holder will indemnify, defend, and hold harmless the Museum from any claim or liability arising from or connected with Holder’s use of the Museum or the acts or omissions of Holder or Holder’s accompanying minor.
- Admission & Ejection. The Museum may refuse admission to, or eject, Holder, along with any accompanying minor, if the Museum determines, in its sole discretion, that Holder or any accompanying minor is disruptive or disorderly (including being under the influence of alcohol, drugs, or other substances) or fails to comply with Museum rules, instructions, personnel, these terms, or any security measures.
- Refunds & Re-Admission. No refunds, exchanges, or re-admission are permitted once Holder or any accompanying minor has entered the Museum.
- General. This is the entire agreement between Holder and the Museum regarding this ticket and is governed by Colorado law, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts in El Paso County, Colorado, and Holder consents to their jurisdiction and venue. If any provision is held unenforceable, it shall be enforced to the maximum extent permitted or, if it cannot be, severed, and the remaining provisions shall remain in effect.
